Reason for Award: A key aspect of this procurement’s single source justification is MOD cumulative investment (over a number of decades) into BAE Systems (Operations) Ltd, as the UK’s lead Air systems integrator. During this time BAE Systems (Operations) Ltd have built up a unique level of credible and capable technical expertise and Suitably Qualified Experienced Personnel (SQEP), and is necessary for the integrated delivery of concepts, associated requirements and the application of technology
Justification For Non-Competitive Decision: This procurement is exempt from advertising in the OJEU under Regulation 7(1) (a) of the Defence Security Public Contract Regulations (DSPCR) due to National Security, and in conjunction with Article 346(1) (a) TFEU, and Regulation 7 (1) (l) of the DSPCR Research and Development (R&D) services exemption (TRL 0-3). This single source justification has Defence Strategic Considerations regarding UK sovereign control of Combat Air technology and skills without third party constraints, as defined in the:
National Security Through Technology 2012 white paper section 3.1.1. Operational Advantage and Freedom of Action, and Article 346 TFEU (1) (b) Warlike Stores of the 255/58 lists in relation to aircraft and their equipment for military use, in particular:
(1) “Operational advantage” – the ability to find and maintain an edge over potential adversaries;
(2) “Freedom of action” – the ability to determine our affairs and act in the country’s interests.
