The procurement falls outside the scope of application of the directive
3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
Under Public Contracts Regulations (2015), this requirement will be procured via the use of the negotiated procedure without prior publication regulation 32 (5) (b) – extension of existing supplies or installations where a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance.
The HR and Payroll system has been in use since 2007 and supports the development of the operational People Strategy.
Significant cost of change would be incurred and would not provide value for money.
