3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The C17, Command Support and Airborne Equipment (C17CSAE) Project Team, part of the UK Ministry of Defence (“MOD”), intends to award an extension to Contract HTPT2B/1024 (“Post Design Services for the Small Boat Modular Platform and Associated Equipment”), covering the period 1.4.2018 to 31.3.2019.
It is considered that this Contract can be placed using the Negotiated Procedure Without Prior Publication of a Contract Notice pursuant to Artice 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical and safety reasons. The requirement cannot be performed without access to the Contractor’s technical know-how to ensure the ongoing safety of the platform and its associated equipment. This technical know-how relates to the Contractor being the designer and manufacturer of the Small Boat Modular Platform; as such they hold and maintain the CAD designs and load model, as well as the engineering expertise to update these tools and analyse the outputs. Without access to these tools and the reports based on the analysis, it is not possible to provide adequate safety assurance that use of the Small Boat Modular Platform does not represent a risk to aircraft or to life.
